Terms of Service

Section 1The agreement

These terms are between you and Deku Studios LLC, a New York limited liability company, which operates Kith. By creating an account or using Kith, you accept them. If you do not, do not use Kith.

Our Privacy Policy explains what Kith does with data and forms part of these terms.

Section 2Your account

You must be at least 18 to hold a Kith account. One person, one account.

You are responsible for what happens under your account.

Section 3What you record about other people

This section matters more in Kith than it would in most products, so read it.

Kith exists to hold information about people who are not its users and who have not agreed to be in it. That is normal for a private address book or a diary, and it is what Kith is for. It also means you carry real responsibility for what you put in.

You agree that:

• You will record information about other people only for your own personal use, in keeping the relationships you actually have.
• You have a lawful basis for holding what you hold. If you are in a jurisdiction where that phrase has a specific meaning, it applies to you and not to us.
• You will not use Kith for surveillance, for building a dossier on someone you do not have a relationship with, for stalking, harassment, or to assemble information about a person against their interests.
• You will handle other people’s information decently. If someone asks you to remove them, remove them.

We may terminate an account we reasonably believe is being used to harm the people recorded in it. That is a judgement we reserve the right to make.

Section 4Accounts you connect to Kith

Connecting your calendar, your contacts or your messages is optional. If you do connect one:

• Connect only an account you are entitled to connect. Not a colleague’s, not a shared inbox you do not control, and not one your employer’s policy forbids you to connect to an outside service.
• You are telling us we may read what those permissions reach, in the shape and for the purposes set out in section 6 of the privacy policy, until you disconnect it.
• You can disconnect at any time, and doing so deletes what that account contributed.

If Kith creates a calendar or drafts a message for you, that is Kith acting at your direction and the result is yours. Kith does not send anything on your behalf, and section 6 of the privacy policy explains what stands behind that sentence.

Where a connected account is provided by a third party such as Google, that third party’s terms govern your relationship with them.

Section 5The Kith helper for Mac

We make a Kith helper application available for your Mac, it is part of Kith and these terms cover it. Installing it requires granting macOS permissions. What it reads, what it sends, and what it publishes about itself are described in section 6 of the privacy policy.

Section 6Your content is yours

You keep every right you have in what you put into Kith. We claim no ownership.

You give us only the narrow permission needed to run the service: to store, process, transmit and display your content back to you, and to send it to the vendors listed in the privacy policy so that Kith works. That permission ends when you delete the content or close your account.

Section 7Using Kith through Claude

Kith is designed to be used through Claude. Connecting the two authorises Claude to send requests to Kith on your behalf and to receive answers.

Anthropic’s terms and privacy policy govern what happens on their side. We do not control Claude, we make no promises about it, and we are not responsible for it. You can revoke the connection at any time.

Section 8What we provide, and what we do not promise

Kith is provided as is. We do not guarantee that it will be available without interruption, free of defects, or that it will never lose data. Keep your own export if something matters to you.

Kith is a memory aid. It is not advice. It records what you told it, and what you told it may be wrong. It also draws conclusions, such as who you have not spoken to lately, from incomplete information. Treat them as prompts rather than facts.

We may change, suspend or discontinue any part of the service. If we discontinue Kith entirely, we will give you reasonable notice and time to export everything before it closes.

Section 9Fees

Kith is currently free. If we introduce paid plans we will say so clearly in advance, and we will not begin charging for something you already have without telling you first and giving you the choice to leave with your data.

Section 10Acceptable use

Do not: break the law with it; attempt to reach another account’s data; probe, scan or attack the service; scrape it; resell it; or use it to build a competing product from our own data rather than yours.

Do not upload content you have no right to hold, including images you obtained unlawfully.

Section 11Ending it

You may close your account at any time, and everything in it is deleted as described in the privacy policy.

We may suspend or close an account that breaches these terms, with notice where it is reasonable to give it and without where it is not. If we close your account for a reason other than a serious breach, we will give you a chance to export.

Section 12Disclaimers

To the fullest extent permitted by law, Kith is provided as is and as available, without warranties of any kind, whether express, implied or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the service will be uninterrupted, timely, secure, error free, or that any data will be preserved without loss.

Section 13Limitation of liability

To the fullest extent permitted by law, neither we nor anyone working with us is liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, loss of goodwill, or the cost of substitute services, arising out of or relating to Kith, whether the claim is brought in contract, in tort, or on any other basis, and whether or not we were told such damages were possible.

Our total liability to you for all claims arising out of or relating to Kith is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for death or personal injury caused by negligence.

Section 14Indemnity

You agree to indemnify and hold harmless Deku Studios LLC and the people who work for it against any claim, demand, loss, liability or reasonable legal cost brought by a third party and arising out of:

• your use of Kith in breach of these terms or of any law;
• information you recorded about another person in breach of section 3;
• an account you connected in breach of section 4; or
• content you uploaded that you had no right to hold.

We will tell you promptly about any claim we expect you to cover, let you take over its defence if you wish, and cooperate with you. We will not settle a claim you are defending without your agreement, which you will not withhold unreasonably.

Section 15Disputes and governing law

These terms, and any dispute arising out of them or out of Kith, are governed by the laws of the State of New York, without regard to its conflict of laws rules.

Disputes will be brought in the state or federal courts located in New York County, New York.

Section 16Changes

If we change these terms in a way that matters, we email the address on your account. Continuing to use Kith after that means you accept the new terms. If you do not, you may close your account and take your data.

Section 17The rest

If any part of these terms is unenforceable, that part is limited or removed to the minimum extent necessary and the rest still stands. If we do not enforce something immediately, we have not relinquished our right to do so. These terms and the privacy policy are the whole agreement between us about Kith. You may not transfer your rights under them; we may transfer ours if Kith is sold, subject to the privacy policy. Nothing here makes either of us the other’s agent or partner, and nobody else acquires rights under these terms.

Sections 3, 6, 12, 13, 14, 15 and 17 survive the end of your account.
